Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of Nani Sore, operated by QuaalCo in British Columbia, Canada. By downloading, accessing or using Nani Sore, you agree to these Terms. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use Nani Sore. If you are under the age required by law in your jurisdiction to enter into these Terms, use the service only with the involvement and permission of a parent or legal guardian where required.

Accounts belonging to users under 16 carry additional protections by default, described in section 8 and in the Privacy Policy.

3. The service

Nani Sore is a photography and AI-assisted content application. Features may include taking photos, analysing photos, generating captions, descriptions, tags and alt text, exploring playful future-looking prompts, saving photos, and sharing content with other users.

Nani Sore is currently in development. Features may change, be added, or be removed without notice, and nothing described on our website is a commitment to ship it.

4. Accounts

Some features, including sharing to the public gallery, require an account. You are responsible for maintaining the security of your account and for activity performed through it. You may authenticate using available methods including Sign in with Apple or email and password. You must provide accurate information, including an accurate date of birth where we ask for one.

You may not create an account on behalf of someone else without their permission, impersonate anyone, or create an account after we have terminated a previous one.

5. Your content

You retain your rights in photos and other content you submit. By using features that require us to store, process or display your content, you grant QuaalCo a non-exclusive, worldwide, royalty-free licence to store, process, reproduce, display and transmit that content solely to operate Nani Sore and provide the features you have asked for. This licence ends when you delete the content or your account, subject to the retention described in our Privacy Policy.

We do not use your content to train AI models, and we do not licence it to anyone else for that purpose.

You must have the necessary rights and permissions for anything you upload or share, including permission from identifiable people in your photos where the law requires it.

6. AI-generated content

Nani Sore uses third-party AI services to analyse photos and prompts. AI outputs can be incorrect, incomplete, biased or misleading. You are responsible for evaluating AI-generated content before relying on or publishing it.

Nani Sore is not a substitute for professional advice of any kind — medical, legal, financial or otherwise. The “My Future” mode is entertainment. It is not a prediction, a reading, or advice, and it should not be used to make decisions.

Generated captions and descriptions may name brands, places or objects incorrectly. Check before you publish.

7. Community rules and acceptable use

Nani Sore includes user-generated content. There is no tolerance for objectionable content or abusive behaviour. You agree not to post, share or send content that:

• Sexualises, exploits or endangers a minor in any way. This is reported to the relevant authorities and results in immediate, permanent termination.
• Is pornographic or sexually explicit.
• Depicts or promotes violence, self-harm, suicide, eating disorders, or cruelty.
• Harasses, bullies, threatens, stalks or targets any person.
• Promotes hatred against people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any other protected characteristic.
• Is illegal, or promotes or facilitates illegal activity, including the sale of drugs, weapons or stolen goods.
• Infringes anyone's copyright, trademark, privacy, publicity or other rights.
• Contains someone else's personal information without their consent.
• Is spam, a scam, a phishing attempt, or deliberately deceptive.
• Impersonates another person or organisation.

You also agree not to attempt unauthorised access, interfere with or disrupt the service, scrape or bulk-download content, circumvent usage limits, distribute malicious software, or use the service to build a competing product.

8. Reporting, moderation and enforcement

Every post can be reported from within the app, and reports can also be sent to nanisore@quaal.co. We aim to review reports within 24 hours and to act on content that breaks these Terms by removing it, restricting the account, or terminating it.

Nani Sore applies automated filtering to content submitted for analysis and publication, ahead of human review. Automated filtering is imperfect and does not replace reporting.

You can also protect yourself directly: mute an account to stop seeing it, or block an account so neither of you can reach the other. Where these controls are not yet available in the build you are using, email us and we will apply the equivalent manually.

Accounts belonging to users under 16 are, by default, restricted to friends-only posting, require approval for incoming follows, are excluded from public discovery, and cannot attach precise location to a post.

We may remove content or suspend accounts at our discretion where we reasonably believe these Terms have been broken, or where necessary to protect users, the service, or comply with law. Repeated or serious breaches result in permanent termination.

9. Sharing and visibility

Every post starts private to your account. If you choose to publish content, other users may be able to view, interact with or otherwise access that content according to the feature's design. Do not share content you expect to remain private.

Content shared publicly may be seen, screenshotted or copied by others despite our controls. We cannot un-see or fully recall content once it has been published.

10. Availability and changes

Nani Sore is provided on an evolving basis. We do not guarantee that any feature will always be available, uninterrupted, or error-free. We may modify, suspend or discontinue features as development continues. Usage allowances, including how many analyses you can run, may change.

11. Subscriptions and payment

Nani Sore is currently free for testing. No subscription tiers are available and nothing in the app charges you today.

If paid subscriptions are introduced, pricing, billing period and renewal terms will be presented clearly before any purchase. Purchases made through the App Store are processed by Apple and are subject to Apple's terms; subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period, and are managed in your App Store account settings. Refunds for App Store purchases are handled by Apple.

12. Termination

You may stop using Nani Sore at any time and may delete your account from within the app — see Delete My Account. QuaalCo may suspend or terminate access where reasonably necessary to protect the service, its users, or to comply with law, or where you have breached these Terms.

Sections that by their nature should survive termination — including content licences already granted for content you have not deleted, disclaimers, limitations of liability and governing law — survive.

13. Disclaimer

To the maximum extent permitted by applicable law, Nani Sore is provided “as is” and “as available”, without warranties of any kind beyond those that cannot legally be excluded. AI results and photo interpretations are provided for informational and creative purposes only. We do not warrant that the service will meet your requirements or that results will be accurate.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

14. Limitation of liability

To the maximum extent permitted by applicable law, QuaalCo will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, arising from or related to your use of Nani Sore. Our total aggregate liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or CAD $50.

15. Indemnity

You agree to indemnify and hold QuaalCo harmless from claims, damages and expenses arising from content you submit, your use of the service, or your breach of these Terms.

16. Apple-specific terms

These Terms are between you and QuaalCo, not Apple. Apple is not responsible for Nani Sore or its content. Apple has no obligation to provide maintenance or support for Nani Sore. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claims relating to the app, including product liability, regulatory compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Governing law

These Terms are governed by the laws applicable in British Columbia, Canada, without regard to conflict-of-law principles. Where you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.

18. Changes to these Terms

We may update these Terms as Nani Sore develops. The effective date above indicates when the current version took effect. For material changes we will provide notice in the app or by email before they take effect. Continuing to use Nani Sore after that means you accept the updated Terms.
